Warrants
For "Class C Misdemeanor" offenses the initial punishment assessed does not include jail time.
There are three types of warrants: warrant of arrest, capias pro fine and capias. The two most common warrants are warrant of arrest, issued when a defendant fails to appear at the initial court setting and capias pro fine, issued when a defendant fails to satisfy the judgment of the court.
If a warrant for you has been issued, you must appear in person to make arrangements on your pending cases. If you voluntarily appear in person to make arrangements, you WILL NOT be arrested.
Warrant of Arrest
A warrant of arrest is a written order from a magistrate directed to a peace officer or some other person specially named to take a person into custody to be dealt with according to law. Art. 15.01, C.C.P.
Warrants of arrest may be issued when a defendant’s fails to appear at the initial court setting.
Capias Pro Fine
A capias pro fine is an order of the court directing a peace officer to bring a defendant who fails to satisfy a judgment before the court immediately or to place the defendant in jail until the business day following the date of the defendant’s arrest if he or she cannot be brought before the court immediately. Art. 45.045, C.C.P.
A capias pro fine may be issued when a defendant fails to satisfy a judgment of the court (failure to comply).
Capias
A capias is a writ issued by the judge of the court having jurisdiction of a case after commitment or bail and before trial or by a clerk at the direction of the judge and directed “to any peace officer of the State of Texas,” commanding the officer to arrest a person accused of an offense and bring the arrested person before that court immediately on a day or at a term stated in the writ. Art. 23.01, C.C.P.
Arrests
If a person is arrested on a City of Laredo Class C Misdemeanor warrant, he or she has the option to post a bond or pay the fine.
Posting a Bond
The Judge will accept a cash bond in order to release a person from jail.
Cash Bond
A cash bond is usually for the amount equal to the fine and fees costs. This bond must be paid in the form of cash, cashier's check, or money order. You will receive a receipt for your payment which will indicate when you must appear in court.
You will be requested to enter into a plea of "Nolo Contendere" or "No Contest." By entering into this plea, you are giving the Judge permission to take the bond money and apply it to the fine in the event you do not appear on your court date. You are not required to enter into the above plea. You have right to appear in court and request any available option for disposing of the charge.
Credit for Time Served in Jail
Credit for time served in jail is determined by the Judge. The defendant must plead guilty to the offense(s) charged.
